Directors Liability For Injury
Directors are at the top of the “chain of responsibility” for injury to anyone working in their business. The “anyone” includes the following:
Directors and management have obligations under the law of negligence to take reasonable care not to cause foreseeable harm to these people and provide a safe and healthy work environment.
While each State or Territory has its own WHS laws, they are harmonised with the model WHS laws nationally. Breaches of such laws will result in prosecution, fines or other penalties for the company and its directors.
It is recommended the Board review all your current WHS policies and procedures and ask management for regular reports of any WHS incidents and steps taken to minimise these risks.
